I have my own work permit. Can I switch to a family permit through my spouse (or the other way round)?
In most cases you can change your type of residence permit without leaving Germany, as long as you meet the requirements of the new one. But calculate beforehand how the change affects your timeline for a settlement permit and citizenship.
Is it possible: Yes, switching from one type of residence permit to another while living in Germany is possible in most cases. For example, if you want to stop working, change jobs or care for your children, you can switch to a family permit through your spouse. Or you can switch from a family permit to your own work permit (for example an EU Blue Card).
To switch to a family permit: Your spouse must have a valid residence permit, and you need adequate housing that you share and enough income to support the family. If your spouse holds a Blue Card, the requirements are easier. You apply to the State Office for Immigration (LEA); apply before your current permit expires.
Things to watch out for: With a skilled worker permit or a Blue Card you can get a settlement permit sooner. If you switch to a family permit, you may lose this advantage. A family permit also depends on the marriage; if you separate in the first years, your residence status may be affected.
Easier rules for spouses: People whose spouse has a settlement permit as a skilled worker (§ 18c) can, under certain conditions, get a settlement permit themselves after three years. Continuing to work (for example at least 20 hours a week) can matter here.
Tip: Before deciding, talk to a free migration counselling service (for example mbeon or the Willkommenszentrum Berlin) and compare the long-term effects of both options.
